Before Destructive Testing Begins: A Field Guide for Construction-Defect Counsel

When a building-envelope dispute reaches the investigation stage, destructive testing can provide the clearest evidence of what is happening behind the finished surface. It can also create new risk if the openings are poorly selected, undocumented, or left inadequately protected.

Attorneys do not need to direct the means and methods of the investigation. However, understanding the field process helps counsel coordinate the owner, building-envelope consultant, engineer, contractor, and other parties while protecting the usefulness of the findings.



Start With a Defined Investigation Plan

Exploratory openings should answer specific questions. Before work begins, the consultant or engineer should identify the suspected failure conditions, the locations most likely to provide meaningful evidence, and the building components that need to remain visible for evaluation.

A focused plan may include representative wall areas, window and door transitions, roof-to-wall conditions, balcony interfaces, base-of-wall details, control joints, flashing locations, and areas associated with known interior leakage. Selecting openings based only on convenience can miss the actual failure path and produce an incomplete picture.


Preserve the Existing Condition Before Demolition

The condition of each test area should be documented before materials are disturbed. Wide-angle photographs establish location and context. Close-up photographs capture cracking, staining, sealant failure, displacement, previous repairs, and other visible conditions.

Each opening should have a unique identifier tied to the building elevation, unit or room, and specific location. Measurements, orientation, weather conditions, and the reason for selecting the area should also be recorded. Consistent identification becomes especially important when several teams are reviewing hundreds of photographs after the site work.


Use Controlled, Layer-by-Layer Removal

Destructive testing should be controlled rather than treated as ordinary demolition. Removing materials one layer at a time allows the consultant and contractor to observe how the wall was assembled and where the conditions change.

Depending on the assembly, the investigation may expose cladding, lath or attachment systems, drainage components, weather-resistive barriers, flashing, sealants, sheathing, insulation, framing, and structural connections. The sequence matters. Removing too much material too quickly can destroy relationships between components that help explain how water entered, where it traveled, and what it damaged.


Document Conditions as They Are Revealed

Documentation should continue throughout the opening—not only before and after it. Useful field records commonly include the sequence of materials, fastener locations, laps and terminations, flashing integration, penetrations, discontinuities, corrosion, moisture staining, deterioration, and dimensions of concealed components.

If samples are removed for laboratory testing or possible evidentiary use, the project team should establish an appropriate identification, handling, storage, and transfer procedure. The attorney and retained experts should determine any formal evidence-preservation or chain-of-custody requirements.


Coordinate the Right Participants

The most productive investigations are coordinated. The consultant or engineer typically directs what needs to be observed and documented. The contractor provides access, controlled removal, temporary protection, safety measures, and practical information about constructability and repair sequencing.

Other participants may include ownership representatives, property management, insurance professionals, opposing parties, testing laboratories, and specialty trades. Confirming access, notice, attendance, work hours, resident coordination, and decision authority before mobilization can prevent delays and disputes in the field.


Protect the Building During and After Testing

Once an exterior wall is opened, the building may be more vulnerable to weather. The investigation plan should address temporary enclosure, water control, occupant protection, fall protection, debris containment, and same-day stabilization.

Temporary protection should be designed for the expected exposure and the length of time the opening will remain in place. A short-duration test opening and an opening left through multiple weather events may require very different protection. Responsibility for monitoring and maintaining temporary conditions should be clear.


Plan for Repair or Reconstruction Early

Testing often confirms that a localized repair will not address the underlying condition. Involving a reconstruction contractor during the investigation can help the team understand access requirements, sequencing, material availability, temporary conditions, and the likely cost implications of alternative repair approaches.

The contractor should not replace the independent judgment of the retained consultant or engineer. The contractor’s value is translating technical findings into executable field work: what must be removed, what can remain, how transitions can be rebuilt, and how the completed assembly can be documented and quality-controlled.
